Terms and conditions
The terms we work under when you appoint 4.digital.

Who we are
4.digital is a search marketing agency working globally and remotely. Our contact address is hello@4.digital. Registered company details, to be completed before publication.
How an engagement starts
Work starts with a conversation, then a proposal in writing. The proposal sets out what we will do, what it costs, what it needs from you, and how long it is expected to take. When you accept it in writing and pay any first invoice, the proposal and these terms form the agreement between us.
What we do
We do the work in the proposal. Search engine optimisation, AI search visibility, paid media, digital PR, content, video, email, analytics and strategy. Anything outside the proposal is a new conversation and a new price.
Fees and payment
We quote a fixed fee or a monthly retainer before anything starts. Invoices are payable within 14 days of the invoice date. Third-party costs (media spend, tools and licences) are agreed in the proposal and billed as agreed. If payment is late, we will talk to you first, and we may pause work after giving written notice.
What we need from you
You give us the access, information and approvals we need to work (analytics and advertising accounts, brand assets, subject matter experts), and you confirm you have the right to use everything you send us. If you are in a regulated market, the claims you publish remain your responsibility. We check work against the rules you give us, and you approve what goes live.
Results and guarantees
Nobody can guarantee a ranking, a traffic level or a revenue figure, and we will not pretend otherwise. What we guarantee is the work, visibility of the work, and reporting you can check. Dates and forecasts in proposals are honest estimates, not promises.
Intellectual property
Work we create for you becomes yours once the relevant invoices are paid. Our methods, templates and pre-existing tools stay ours. Third-party platforms keep their own terms, and the licences for tools we use on your behalf stay in our name unless we agree otherwise.
Confidentiality
Each of us keeps the other's non-public information confidential and uses it only for the engagement. This survives the end of the agreement.
Data protection
We handle personal information as described in our privacy policy. Where we process personal data on your instructions, for example inside your analytics account, we act as a processor under a written agreement we can provide on request.
Case studies and portfolio
We would like to show the work. Unless you tell us otherwise, we may name you as a client and show non-confidential results in case studies and pitches. You can withdraw that permission at any time, and anything we agree in writing about confidentiality overrides this section.
Cancellation and termination
Retainers can be ended by either of us with 30 days' written notice, or on whatever the proposal says. Fixed-scope projects can be ended as the proposal says, with payment for work done up to that point. We can end an engagement immediately if an invoice remains unpaid after written notice, or if continuing would break the law.
Liability
We carry out the work with reasonable skill and care. Neither of us is liable for indirect or consequential losses. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim, except where the law does not allow that limit.
Things outside our control
Neither of us is responsible for failures caused by events outside reasonable control, including platform outages, algorithm and policy changes, market shocks and the actions of third-party providers.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer elsewhere, your mandatory local rights still apply.
Changes to these terms
We post changes here and apply them to new work. Engagements already agreed continue under the terms they started with unless we agree otherwise.
